In these Terms and Conditions "we", "our", "us" and "Vacation Rental People" refer to Vacation Rental People.com LTD.

ACCEPTANCE OF TERMS

By accessing www.owners.vacationrentalpeople.com ("the Website") you agree to be bound by the terms and conditions set out herein and you accept our privacy policy available at www.vacationrentalpeople.com/privacy.aspx. If you object to any of the terms and conditions set out in this agreement, you should not use any of the products or services on the Website and leave immediately.

These terms are additional terms for advertisers on the Website, and are in addition to the standard terms and conditions of use that govern use of the Vacation Rental People.com websites, which can be found at www.vacationrentalpeople.com/tc.aspx
In the event of any inconsistency between these additional terms for owners and the standard terms, these additional terms shall prevail.

GENERAL

You agree that you shall not use the Website for illegal purposes, and will respect all applicable laws and regulations. You agree not to use the website in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Website. You also agree not to compromise the security of the Website or attempt to gain access to secured areas or sensitive information.

You agree to be fully responsible for any claim, expense, liability, losses or costs, including legal fees, incurred by us arising from any infringement of the terms and conditions set out in this agreement.

As a condition of your use of this site you will not:

1) Post any unlawful, abusive, defamatory, obscene or indecent information or images.

2) Post or transmit any material or images of any kind that violates or infringes upon the rights of any other persons or any material that is protected via trademarks or any proprietary right, without receiving permission from the owner or relevant owner.

PRICING

Advertising prices are guaranteed for the duration of the subscription period (usually 12 months for property listings and monthly/quarterly/half yearly for premium listing and featured properties as indicated). We reserve the right to change our prices by publishing on the website and revised prices will come into effect for all renewals and new subscriptions contracted after the published date.
For the avoidance of doubt, you will not be charged without having to explicitly agree to any charges that we levy. If you have signed up for a free advertising trial, your advert will automatically expire at the end of the free period unless you choose to renew it at the published rates in force at the time. There is no requirement for you to renew.
Periods of advertising are sold for calendar months starting from the date of initial activation of each property. You are able to temporarily or permanently deactivate your adverts but there is no discount or refund available for periods of time where you have chosen to deactivate your advert from our site.

RESPONSIBILITY FOR ACCURACY AND CURRENCY OF PROPERTY INFORMATION:

All advertisements should comply with all relevant legislation, including the UK Trade Descriptions Act 1968 (which covers false descriptions) and the Consumer Protection Act 1987 (which covers misleading prices). The advertiser agrees to indemnify Vacation Rental People against all claims or costs arising out of any misleading information in the advertisement.

Vacation Rental People will take every care to reproduce faithfully all details text and photographs provided to us by advertisers. We will not however be held liable for any loss arising out of any error or omission on our part. Vacation Rental People reserves the right to determine the design and layout of advertisements, and (at our discretion) make alterations to submitted text or photographs, should we consider any to be necessary. Vacation Rental People will not be held liable for any loss arising out of such alterations.

MODIFICATION

Vacation Rental People reserve the right to change any part of this agreement without notice. If you do not agree with the revised Terms and Conditions you have the right to be governed by the set of Terms and Conditions in force at the time of the commencement of your advert until such time as that advertising period expires. Any renewals of existing adverts or new adverts will be subject to the Terms and Conditions in force at the time of renewal

LIMITATION OF LIABILITY

Vacation Rental People will under no circumstance be liable for indirect, special or consequential damages, including any loss of business, revenue, profits or data in relation to your use of the Website.

COPYRIGHT

All intellectual property of Vacation Rental People such as trademarks, trade names, patents, registered designs and any other automatic intellectual property rights derived from the aesthetics or functionality of the Website remain the property of Vacation Rental People.

By using the Website you agree to respect the intellectual property rights of Vacation Rental People and will refrain from copying, downloading, transmitting, reproducing, printing, or exploiting for commercial purpose any material contained within the Website. Vacation Rental People.com is designed for private use by persons searching for holiday or vacation homes.

The advertiser represents and warrants that he:

(1) Owns the copyright in the photographic and textual material supplied by him to Vacation Rental People (the Material and Text) or

(2) Has been authorised by the owner of the copyright in the Material to grant Vacation Rental People permission to use the Material as contemplated below.

The advertiser grants Vacation Rental People a perpetual, royalty-free licence to use the Material for promotional purposes (including public relations material and marketing). The advertiser irrevocably and unconditionally indemnifies Vacation Rental People immediately on demand against any cost, loss or liability (including legal costs), which Vacation Rental People may incur by reason of any breach of copyright arising from its use of the Material. The advertiser understands that it may not reproduce photographic or textual material from any part of the Vacation Rental People website without permission from the relevant copyright owner.

PROVISION OF SERVICES

We endeavour to ensure that the Website will be available 24 hours a day, every day of the year but can not guarantee uninterrupted availability of the www.vacationrentalpeople.com Website and cannot provide any representation that using the Website will be error free. Vacation Rental People have complete discretion to add, modify, update or remove any part of this site without warning or liability arising from such action.

MARKETING

Vacation Rental People use various external marketing and advertising sources to generate traffic and to drive traffic towards our site and your property listing. You agree to allow your property details in whole or in part to be individually featured, or featured as part of a group, as long as your personal details are not disclosed to any third party. All marketing and advertising is aimed towards generating enquiries through our website.

SEVERANCE

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.

CONTACT DETAILS

By creating an account on the Website, you agree to provide a valid email address to be used as primary form of contact and to inform and update Vacation Rental People if this address changes. You also agree that Vacation Rental People may contact you by email with a monthly newsletter, with information regarding new services, offers and updates relating to the Website and for matters relating to the administration of your properties.

GOVERNING LAW AND JURISDICTION

The laws of England will govern this Agreement and any user of the Website hereby agrees to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws.

Automatic Renewals

Auto-renewal applies to products purchased by credit card on or after June 14, 2011.

Once you’ve renewed your subscription after this date, your listing will automatically renew on the credit card specified on your account. This renewal will occur on the listing’s expiration date at the renewal rate for that date, in the currency you paid for previously, and will include VAT at the appropriate rate based on your country of residence, and whether you are running the property as a business. You will be informed by email one week prior to the renewal, and also on the day the card is charged.

The automatic renewal will apply to

1) 12-month advertising at the price for the date of renewal.
2) 12-month Featured Listings, if purchased with the current advertisement, at the price for the date of renewal
2) 12-month Premium Listing Upgrade if purchased with the current advertisement, at the price for the date of renewal

VacationRentalPeople.com do not store credit card information, and are fully compliant with PCI-DSS.
